Agreement to Terms

By accessing or using any page, tap card, QR code, or digital asset operated by Harbor Tap, a service operated by Harbor Web Solutions ("we," "us," or "our"), you agree to be bound by these Terms of Use and our Privacy Policy.

If you do not agree to these terms, please discontinue use of our pages immediately.

These Terms apply to all visitors, regardless of whether you arrived via NFC tap, QR code, direct URL, or any other means.

Services Described

Harbor Tap and Harbor Web Solutions provide the following products and services:

  • Custom NFC tap cards and digital business card pages
  • QR code creation and linked landing pages
  • Digital contact pages and business landing pages
  • Contact and lead capture forms
  • Analytics tracking and tap/scan engagement reporting
  • Custom website design and development for small businesses

Services are provided to clients on a project or subscription basis. End users interacting with client tap card pages are visitors, not direct clients of Harbor Web Solutions unless a separate agreement exists.

Acceptable Use

You agree not to use our pages or services for any of the following:

  • Any unlawful, fraudulent, or deceptive purpose
  • Scraping, automated data collection, or reverse engineering
  • Attempting to interfere with or disrupt our pages, servers, or networks
  • Impersonating any person, business, or entity
  • Submitting false, misleading, or malicious information through contact forms
  • Transmitting spam, malware, or harmful content

We reserve the right to block access to any user or device that violates these terms.

Intellectual Property

All design, content, code, graphics, logos, and branding elements on pages operated by Harbor Web Solutions are the property of Harbor Web Solutions or our respective clients, and are protected by applicable copyright and intellectual property laws.

You may not reproduce, copy, redistribute, or repurpose any content from our pages without prior written permission from Harbor Web Solutions or the relevant rights holder.

Client-owned content (such as business logos, photos, and trade names) remains the property of the respective client.

Third-Party Platforms and Services

Our tap card and landing pages may link to or interact with Instagram, Facebook, Meta services, SMS and phone applications, client websites, Google Business pages, mapping services, and other third-party websites or applications.

Harbor Tap and Harbor Web Solutions are not responsible for the availability, privacy practices, content, accuracy, or operation of third-party services. We make no warranties or representations about third-party destinations and do not endorse them unless explicitly stated.

Clicking an external link, opening a phone or SMS application, or interacting with a third-party platform is done at your own discretion and risk. We encourage you to review the terms and privacy policies of any third-party service before engaging with it.

Website Analytics and Advertising

The site may use analytics and advertising technologies to measure usage, improve the site, attribute ad performance, and display relevant advertising.

No Guarantee of Advertising Results

Harbor Tap and Harbor Web Solutions do not guarantee a specific number of leads, sales, messages, conversions, website visits, traffic, or advertising performance.

Results depend on factors outside our control, including offer quality, audience behavior, ad platform policies, budget, competition, market conditions, creative assets, and third-party platform performance.

Disclaimer of Warranties

Our pages and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, Harbor Web Solutions disclaims all warranties including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Uninterrupted or error-free operation of our pages
  • Accuracy, completeness, or reliability of any content displayed
  • Security of data transmitted through our pages

We do not warrant that our pages are free from viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by California and federal law, Harbor Web Solutions and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

In no event shall Harbor Web Solutions' total liability to you for any claim exceed the amount you paid, if any, for access to the specific service giving rise to the claim.

Use at Your Own Risk

Your use of Harbor Web Solutions' pages, tap cards, QR codes, and any linked services is entirely at your own risk. While we take reasonable steps to provide accurate and functional digital assets, we cannot guarantee outcomes, uptime, or the behavior of third-party integrations.

Submitting personal information through contact or lead forms, clicking external links, or making purchasing decisions based on content found on our pages is done at your own discretion. Harbor Web Solutions is not liable for decisions made based on information presented on client tap card pages.

Changes to Services & Content

Harbor Web Solutions reserves the right to:

  • Modify, update, or discontinue any page, tap card, or service at any time without notice
  • Change pricing, offerings, or availability of services without prior announcement
  • Update these Terms of Use at any time
  • Suspend or terminate access to any page at our sole discretion

Continued use of our pages after any changes to these Terms of Use constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

We are not obligated to maintain any specific page, feature, or service in perpetuity, including client tap card pages after a service agreement ends.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our pages shall be subject to the exclusive jurisdiction of the courts located in California.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
